Inclusion Europe to host fourth Round Table on Legal Capacity

Inclusion Europe has announced its fourth edition of the Round Table on Legal Capacity, which will take place on 27 November in Strasbourg. Legal capacity is an important issue affecting people with intellectual disabilities today.

Inclusion Europe has announced its fourth edition of the Round Table on Legal Capacity, which will take place on 27 November in Strasbourg.

Legal capacity is an important issue affecting people with intellectual disabilities today. With countries moving away from the approach of substitute decision-making towards supported decision-making models, much of the debate throughout the event will focus on  reforming approaches to decision-making and legal capacity in European Union member states.

This year, the United Nations Committee on the Rights of Persons with Disabilities (UN CRPD) has published its first General Comment of Article 12 of the Convention, which relates to equal recognition before the law, and to the recognition that all people with disabilities should have the legal right to make decisions.

The General Comment will thus be an important focal point of debate at the Round Table. Now that the UN CRPD has issued a further clarification on the definition of the term ‘support,’ as well as offering a clear differentiation between substitute and supported decision-making, Inclusion Europe is keen to combine a discussion on the legislative approach of the United Nations and with the practical approaches offered by its new online supported decision-making platform ‘Choices’, which presents a range of supported decision-making models for people with intellectual and other disabilities.

Among those present at the event will be representatives of the Council of Europe and a number of European Union institutions, as well as members from the Fundamental Rights Agency and other NGOs active in the disability field.

The event will be hosted in cooperation with the Council of Europe and will take place at its Strasbourg seat, the Palais de l’Europe.
